Defective Product Lawyer

In the United States, thousands of products are recalled every year. Recalls remove products that are defective, dangerous, or that violate regulatory requirements from the market. Product recalls are typically conducted by manufacturers, distributors, and retailers, and are usually done in cooperation with government regulatory agencies like the Consumer Product Safety Commission (CPSC). An experienced defective product lawyer explains that in rare instances, if a manufacturer, distributor, or retailer refuses to issue a recall, the CPSC can gain a court order to force a recall. The goal of a product recall is to protect consumers from products that may cause harm, and to correct the problem that caused the defect or violation.

Depending on the severity of the problem and the type of product, recalls can offer different remedies. In some cases, a recall may involve a repair or replacement of the product, and in other cases the product may need to be returned or destroyed.

When a recall is announced, companies will often provide consumers with instructions on how to return or dispose of the product and information on how to receive a refund or replacement. The company will also notify the public through various means such as email, advertisements, press release announcements, and through government regulators like the CPSC.

While any product can be recalled, product categories that are frequently subject to recalls are:

  • Toys and other goods for babies or children
  • Car seats
  • Vehicles and vehicle parts
  • Appliances
  • Furniture

Rock n’ Play Sleeper Recall

On January 9th, 2023, Fisher-Price recalled all models of Rock n’ Play Sleepers after the product caused at least eight infant deaths following the initial recall of the Rock n’ Play Sleepers in 2019. Infants have died in the Rock n’ Play Sleepers after rolling from their back to their stomach or side while unrestrained. Currently all models of the Rock n’ Play Sleepers are included in the recall and consumers who own any model of the Rock n’ Play Sleeper should stop using the product immediately and contact Fisher-Price for a refund or voucher. The Rock n’ Play Sleepers were sold at major stores nationwide including Target and Walmart and online at Amazon.com from September 2009 through April 2019.

In 2019, when the first recall of the Rock n’ Play Sleepers was announced, more than 30 infant fatalities had been reported to have occurred. Since the 2019 recall, 70 additional fatalities were reported, including eight fatalities that reportedly occurred after the initial recall.

Defective Product Lawsuits

If you have suffered an injury or other harm due to a defective or dangerous product, you may be wondering how you can secure compensation. Filing a lawsuit against the manufacturer, distributor, or retailer of the defective product may be the right option for you. Defective product lawsuits are legal proceedings in which a person files a claim against a company for damages caused by a defective product.

Generally, to bring a product defect claim, a plaintiff must prove the following:

  • The product was defective.
  • The product defect caused your damages.
  • You were using the product in its intended manner at the time of injury.
  • The manufacturer was aware of the defect or had reasonable grounds to know it existed.

If you are considering filing a defective product lawsuit, it is important to work with an experienced product defect attorney who can ensure that you have the best chance of bringing a successful claim. If your claim is successful, you will receive damages for the losses you suffered due to the defective product. Damages may include compensation for medical expenses, lost wages, pain and suffering, and emotional distress. A successful claim can also help other consumers who have suffered from the same product defect and may help deter companies from designing and selling similar defective products in the future.
